Who can get the benefit of the new pathology without having to go through INSS medical studies? The insured person who will request payment for the pathology from INSS (National Institute of Social Security) without going through the medical experience, can only make the request and send the necessary documents through the Meu INSS request, according to the institute's rules published on Monday (29).
Ordinance 1,486 also provides other relevant guidelines, such as the total distance period for those who do not experience the situation in person, which is up to 90 days, in addition to the 30-day limit for planning a medical examination, if necessary.
According to legal expert Rômulo Saraiva, a specialist in Social Stability and columnist for Folha de S.Paulo, specifying the reasons for requesting disability benefits in the INSS (Brazilian National Social Security Institute) application could negatively impact the insured individual. He argues that there are constant flaws in the INSS system and, furthermore, people without access to mobile phones and the internet will have difficulty obtaining the benefit.
"Beyond the complexity of the Internet is the connection, as it is a system that shows a lot of instability, which can be distressing and fatal for those whose days are numbered," he says.
The publication contains guidelines regarding the physician's certificate for requesting assistance without specialized knowledge. According to the decree, the document must be legible and issued less than 30 days before the request.
The certificate of leave for pathology without medical examination must include:
- Full name of the insured person
- Start date of time off
- Primary time period for recovery from the pathology.
- Signature and identification stamp of the physician, with registration at the professional council, which may be CRM (Regional Council of Medicine), CRO (Regional Council of Dentistry) or RMS (Registration with the Ministry of Health).
- Pathological data or ICD (International Classification of Diseases)
The insured person must request the "Temporary Disability Benefit – Documentary Study – TIA". Those who already had a medical specialization scheduled have the possibility of trying to obtain support by sending documents. In this situation, the medical examination will be canceled.
After submitting your application through the INSS (Brazilian National Social Security Institute), you will be informed of the duration of the benefit granted, which is up to 90 days, even if the sick leave is not consecutive. Furthermore, it is not possible to request an extension if you are still ill.
If the inability persists, the resident will have to submit a completely new application for sick leave benefits, this time with an in-person assessment by a doctor, but only 30 days after the end of remote assistance.
Another rule establishes that, if another leave is required within 60 days for the same reason, the worker cannot request support again without a medical examination.
How is the analysis done to obtain the benefit?
The submitted documents will be analyzed by INSS medical professionals. The objective is to prevent fraud and to understand if the sick leave period corresponds to the pathology. If you need to undergo a medical examination, you will be notified and will have to schedule the examination within 30 days.
In cases where the applicant is personally notified, the INSS guarantees that the initial date of the request will be the day the resident submitted the documents through the INSS.
