The Municipality of Senhor do Bonfim responds to the SISMUSB's Note of Repudiation.
The Municipality of Senhor do Bonfim hereby expresses its opinion regarding the SISMUSB's Note of Repudiation, stating that at no time has the municipal administration failed to respect the primary function of the category's representative entity; on the contrary, it has always acted transparently and democratically, never refusing to address issues inherent to the category, as in the case referred to by the Union, in which the Municipal Administration itself invited a representative of SISMUSB, who was present at the meeting but chose not to participate because he preferred to join a former employee who is no longer part of the municipality's active staff.
Retirement is considered a vacancy in the position.
It should be noted that Article 40, item IV of the Civil Servant Statute is clear in defining retirement as a reason for vacancy of the position.
Therefore, in these cases, the employee ceases to have any connection with the Administration, being nothing more than a former employee who, in this specific case, should have left the permanent staff since 2020. However, they chose to remain silent and did not inform the Administration of the approval of their retirement by the INSS (Brazilian National Institute of Social Security), behaving improperly as if they were an active employee, even enjoying union leave.
By cross-referencing data with the INSS (Brazilian National Social Security Institute), the Human Resources department detected the retirement and initiated an administrative process that resulted in the dismissal of the employee.
Therefore, it is important to emphasize that the Administration values and will continue to foster dialogue with the category through its legitimate representatives in order to better achieve solutions that involve those who are actually municipal employees.
