Public tender suspended in Philadelphia.

The public competition held by the Municipality of Filadélfia to fill vacancies in the City Hall's staff was suspended this Friday (14), on a preliminary basis, by the Court. The suspension was requested in a public civil action filed by the State Public Ministry, through Public Prosecutor Leonardo Rodrigues Silva, against the Municipality and Planejar Consultoria e Planejamento Ltda.

Judge Cícero Alisson Barros also ruled that the Municipality should not summon, appoint, or swear in the approved candidates until a new decision is made.

According to the public prosecutor, discrepancies were identified between the score given in the final result and the score in the answer key. Furthermore, the Terms of Reference were not found in the bidding process, containing only a generic justification without criteria for acceptance of the object or deadlines, and without specifying the estimated value of the service to be contracted.

The announcement also failed to provide for the filing of appeals at any stage of the selection process, explains Leonardo Rodrigues, stating that this violates the principle of due process.

According to the lawsuit, candidates were not provided with information about how their qualifications were scored (correction criteria), so without the possibility of a detailed analysis of each scored item, their right to appeal was compromised. Another irregularity detected by the Public Prosecutor's Office was the absence of participation by the Brazilian Bar Association in the selection process, even though there was a vacancy for a lawyer. The Public Prosecutor recalls that he issued a recommendation advising the Municipality to suspend the competition, but it was not heeded.
